Terms of Use
These terms apply when you use the Andzani Loan Folks website, submit or save a loan application, or access the customer portal.
1. About us and these terms
Andzani Loan Folks is registered with the National Credit Regulator under number NCRCP16071. By using this service, you agree to these website terms and acknowledge the separate Privacy Policy. If you do not agree, do not submit an application or use a portal account.
2. Eligibility
You must have legal capacity to apply, provide a valid South African identity number, and meet the eligibility and affordability requirements communicated during assessment. Submitting an application does not establish eligibility or create a credit agreement.
3. Accurate application information
You must provide complete, current, and truthful information and documents. You may not impersonate another person, alter supporting records, or hide information material to an affordability or risk assessment. Contact us promptly if submitted details change or are incorrect.
4. Identity, affordability, and credit checks
Where you provide the required consent, we may verify identity and application information, assess affordability and fraud risk, and request information from credit bureaux or other lawful verification sources. We may ask for additional evidence before making a decision.
5. No guarantee of approval
An online estimate, saved application, submission confirmation, portal status, or communication is not a promise of approval or funding. A final offer is subject to assessment, applicable law, internal approval, and any outstanding verification requirements.
6. Final quotation and credit agreement
If approved, the binding loan amount, interest, fees, total cost, payment dates, and other obligations will be set out in the pre-agreement statement, quotation, and credit agreement presented to you. Review those documents before acceptance. If these website terms conflict with a signed credit agreement, the agreement and applicable law govern the credit relationship.
7. Repayments
You must make repayments in the amounts and on the dates stated in an accepted credit agreement. Contact us as soon as possible if you anticipate difficulty paying. Late, missed, reversed, or rejected payments may have the consequences described in the agreement and permitted by law.
8. Documents and account security
Upload only relevant, lawful documents that belong to you or that you are authorised to provide. Keep sign-in and password-reset links confidential, choose a strong password, and sign out on shared devices. Notify us immediately if you suspect that an account, email link, or document has been accessed without permission.
9. Electronic communications
You agree that application and service communications may be delivered through the portal, email, SMS, or the contact details you provide, subject to applicable law. Keep those details current. Delivery can be delayed by third-party networks, spam filters, or unavailable services; use the portal or contact us if an expected message does not arrive.
10. Privacy
Personal information is handled as described in our Privacy Policy. Application data may be processed for identity, affordability, credit-risk, fraud-prevention, customer-service, agreement, reporting, and lawful record-keeping purposes.
11. Acceptable use
You may not:
- attempt to bypass access controls, rate limits, security checks, or another customer’s account;
- upload malware, unlawful material, or content that infringes another person’s rights;
- scrape, overload, reverse engineer, disrupt, or misuse the website or its APIs; or
- use the service for fraud, money laundering, harassment, or any unlawful purpose.
We may restrict access where reasonably necessary to investigate misuse, protect customers, or comply with law.
12. Availability and liability
We aim to keep the service accurate and available, but maintenance, network failures, third-party services, or events beyond reasonable control may interrupt it. Nothing in these terms excludes liability or customer rights that cannot lawfully be excluded. To the extent permitted by law, we are not responsible for indirect loss caused solely by an unavailable website, a customer’s compromised credentials, or third-party systems outside our reasonable control.
13. South African law
These website terms are governed by the laws of the Republic of South Africa. Mandatory rights and remedies under the National Credit Act, Consumer Protection Act, POPIA, and other applicable law remain unaffected. A competent South African court or authorised regulator may hear a qualifying dispute.
14. Questions and complaints
Contact us at info@andzaniloanfolks.co.za and include your application reference where available. Do not send a password or complete banking credentials by email. If we cannot resolve a regulated complaint, we will provide or confirm the appropriate external escalation route for the issue.
15. Changes
We may update these terms to reflect service or legal changes. The current version and effective date will be posted here. Changes do not retrospectively replace an accepted credit agreement.
